General terms and conditions

GENERAL

By submitting a reservation request, you declare your unconditional agreement with the rental conditions below.

Therefore, please carefully read them when you wish to make a reservation.

Deviation from the rental conditions can only occur if the owner gives his prior, written, consent.

Only bookings from individuals aged 18 and above will be considered. The tenant must be 18 years or older and be present during the stay.

 

PAYMENT

An advance payment of 50% of the total rental price for the stay must be transferred to the owner’s bank account within one week after sending the signed reservation form. The final balance of the total rental price must be transferred to the owner’s bank account no later than 5 (five) weeks before the start of the rental period.

 In case of a late or incomplete payment of the advance or final balance, the owner is entitled to unilaterally terminate the agreement with simple notification and without prior notice. Any sums already paid will belong to the owner as a fixed compensation.

3. CANCELLATION BY THE TENANT

Any cancellation of a made reservation must be confirmed in writing by the tenant. In the case of cancellations, the following fees apply:

  • A cancellation of more than 5 weeks before the arrival date: 30% of the rent is withheld as a cancellation fee.

  • A cancellation of less than 5 weeks and more than 4 weeks before the arrival date: 50% of the rent is withheld as a cancellation fee.

  • A cancellation of less than 3 weeks before arrival: 90% of the rent is withheld.

  • A cancellation on the first day of the stay or later incurs a cancellation costs of 100% of the total cost.

4. CANCELLATION BY THE LANDLORD

In the unlikely event that the owner must cancel the reservation (as a result of pandemics, strikes, fire, floods, or any other disruptions or events), the tenant will be immediately notified, and the landlord will refund the amounts already paid as soon as possible. The tenant is not entitled to any compensation other than the refund of the amount paid.

 

5. DEPOSIT

The tenant pays a deposit of €750, which must be paid together with the balance and no later than 5 weeks before the start of the rental period. If no damage has been caused to the accommodation, you will receive the full deposit back after the stay. The owner is not responsible for necessary costs in case of damage. The deposit will be refunded after the end of the stay, minus the costs of any damage that was made to the house.

If it appears that extra time is needed for the final cleaning (e.g., due to dishes or extra garbage left behind), additional cleaning costs of €45 per hour will be charged in addition to the agreed cleaning fee of €150. The deposit will be used to pay these additional cleaning costs.

 

6. LIABILITY

The landlord accepts no liability for theft, loss, accidents, damages (including personal injuries) of any kind during or as a result of a stay in the house. Liability is also excluded for changes in or near the accommodation that have occurred without the fault of the owner.

Throughout the entire stay, the tenant, their co-tenants, and any visitors for whom they vouch, must behave with due care at all times, taking into account the peace of the surroundings.

 The tenant and those accompanying them are jointly liable for all loss and/or damage that will occur to the owners and/or any third party as a direct or indirect result of their stay (even if this damage and/or loss is only determined after their departure), regardless of whether it was caused by their own actions or omissions or those of third parties present in the accommodation due to their actions. The following actions are strictly prohibited and, if not adhered to, may result in eviction and/or partial or full withholding of the deposit without any compensation to the tenant, while all rights of the landlord are retained:

  • Occupying the house with more people than stated on the booking form.

  • Causing noise disturbances between 22:00 and 06:00.

  • Bringing pets during the stay.

  • Smoking indoors.

  • Hosting parties, student gatherings, and bachelor parties.

 

The house rules provided and/or available at the holiday home are an integral part of the rental agreement and must be strictly followed. 

7. GENERAL

 If urgent repair work becomes necessary due to unforeseen circumstances, the landlord has the right to enter the house during the rental period and have the renovation work carried out, without any further liability of any kind, and without the tenant being entitled to a reduction in the rental price.

The invalidity of one or more provisions of these general conditions or any part thereof does not affect the validity and enforceability of the remaining provisions. In case of invalidity, the parties will negotiate to replace the invalid provision with an equivalent provision in accordance with the spirit of these general conditions. If the parties do not reach an agreement, the competent court may adjust the invalid provisions to what is legally permissible.

 

This agreement is subject exclusively to Belgian law. All disputes will be settled exclusively by the courts of Bruges.
